Terms of Service

The short version: use Deske for legitimate business purposes, keep your account secure, pay the bill, and don’t be a jerk. The longer version is below.

By using Deske you agree to these terms. They cover what we provide, what we charge, what you're responsible for, and the limits of our liability.

The basics

By using Deske you agree to use the service for legitimate business purposes only, to keep your account credentials secure, and to abide by applicable telecommunications and consumer protection laws in your jurisdiction.

You're responsible for the content of the calls, texts, and bookings you facilitate through Deske, including compliance with TCPA, A2P 10DLC, state-level recording disclosure laws, and any clinical/legal requirements specific to your practice.

Billing

Deske's listed plans are $500 / month (Regular) and $1,000 / month (Healthcare) per business; your signed agreement or order form may specify different pricing, which controls. Each subscription includes 500 voice minutes per month; unused minutes do not carry over. A payment method or an invoicing agreement is required at signup; the first charge or invoice is issued on the day you complete setup. Overage voice minutes beyond the 500-minute monthly pool are billed at $0.50/minute at the end of each monthly cycle.

  • You can cancel any time from the billing portal.
  • Cancellations take effect at the end of the current billing period. We don't pro-rate refunds for partial months.
  • Failed charges are retried up to three times; after that, service is paused until billing is resolved.
  • Local sales tax may apply based on your state.

Acceptable use

Don't use Deske to:

  • Send unsolicited marketing texts (SPAM), or attempt to circumvent carrier filtering.
  • Collect or process protected health information beyond appointment scheduling — Deske is not a HIPAA-covered entity.
  • Operate any service that requires HIPAA BAA coverage, SOC 2 attestation, or PCI scope we have not explicitly granted.
  • Attempt to reverse-engineer Aria's voice, prompts, or transcripts for resale.

Text messaging (SMS) terms

Practices on Deske send appointment-related text messages — confirmations, reminders, recall notices, booking follow-ups, and customer-care replies — to patients and clients who have opted in.

  • Opt-in. Patients/clients consent when they book by phone or through the practice's booking page and provide a mobile number for appointment updates. Consent to receive texts is never a condition of purchasing any goods or services.
  • Message frequency varies with the recipient's appointments (typically a few messages per appointment).
  • Message and data rates may apply, depending on the recipient's carrier plan.
  • Opt out at any time by replying STOP to any message; reply HELP for help, or contact the practice directly.
  • Mobile carriers are not liable for delayed or undelivered messages.

Preview note. This is preview copy. The final liability and warranty language will be replaced with counsel-reviewed terms before public launch. Substantive billing, cancellation, and acceptable-use provisions above are stable.

Liability

Deske is provided as-is during this preview period. Service availability and feature scope may change. To the extent permitted by law, Deske's aggregate liability for any claim is limited to the fees paid in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost revenue, lost calls, lost bookings, or third-party carrier outages outside our reasonable control.

Changes & termination

We may update these terms with notice via email and in-app. Material changes — pricing, liability scope, or acceptable use — get at least 30 days' notice. Continuing to use Deske after the effective date constitutes acceptance.

We may suspend or terminate accounts that violate these terms, with notice when reasonable. In the event of termination, you can export your data from the billing portal for 60 days.
